However, due to recent events of the Preventing Online Sales of E-Cigarettes to Children Act being signed into law by President Trump on the 27th of December 2020, the definition of tobacco products has now been extended to include vape and vape related products. In short, harsher restrictions on shipment of vape products have been put into place. Therefore, according to the Prevent All Cigarette Trafficking (PACT) Act online retailers/wholesalers must comply with the following:
Register with the U.S. Attorney General.
Register with federal government and tobacco tax administrators. This must be done for every state their products are sold in.
Taxes must be collected and tax stamps must be added on all products sold.
Maintain a list of transactions in each state and report it to the respective state’s tax administrator. This must include the customer’s name, address and product they purchased.
Verify customers age through a commercially accessible database.
Ensure their shipping service collects an adult signature on delivery.
To ensure the packages are not violating the PACT Act, a 5-year delivery record must be maintained.
